You represent and warrant that you are at least eighteen (18) years of age and legally capable of entering into binding agreements.

By purchasing or using our services, you expressly acknowledge and agree that:

• There is no guarantee of any specific outcome, including but not limited to sales volume, lead quality, conversion rates, or revenue.
• Filing a chargeback, payment dispute, or reversal through your bank, card issuer, or payment processor constitutes a material breach of these Terms.
• In the event of a chargeback or dispute, Ignis Scaling reserves the right to recover the full outstanding balance, administrative fees, legal fees, and collection costs.

To the fullest extent permitted by applicable law:

• Ignis Scaling does not guarantee the accuracy, quality, legality, or convertibility of any lead, campaign, or service.
• All services are provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise.
• We make no representations or guarantees regarding the effectiveness, reliability, or suitability of any marketing strategy, platform, or channel used.

You expressly understand and agree that Ignis Scaling shall not be liable for:

• Any loss of revenue, profits, goodwill, or data
• Any indirect, incidental, special, punitive, or consequential damages
• Any damages exceeding the total amount paid by you to Ignis Scaling in the thirty (30) days preceding the event giving rise to the claim

To the maximum extent permitted by law:

• You waive any right to bring or participate in a class action, collective action, or representative proceeding.
• You waive the right to a jury trial.
• Any claim or dispute must be brought individually and only after providing written notice and allowing sixty (60) days for good-faith resolution.

Nothing in this section prevents either party from bringing an eligible claim in small claims court, where applicable.

You agree to indemnify, defend, and hold harmless Ignis Scaling, its officers, directors, employees, contractors, and agents from any and all claims, damages, liabilities, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use or misuse of our services
• Your violation of any applicable laws or regulations (including but not limited to TCPA, GDPR, CAN-SPAM)
• Any disputes, claims, or liabilities involving customers or leads you acquire through our services

By submitting your phone number through our website, landing pages, forms, or any other opt-in mechanism, you expressly consent to receive marketing, transactional, and promotional SMS messages from Ignis Scaling LLC (DBA: Ignis Scaling).

All non-public information shared between the parties is confidential. You agree not to disclose, misuse, or exploit any confidential information without prior written consent.

Any breach of confidentiality may result in immediate termination of services and legal remedies.

Ignis Scaling reserves the right to modify or update these Terms at any time. Continued use of the services after changes are posted constitutes acceptance of the revised Terms.

Ignis Scaling shall not be liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, internet outages, governmental actions, labor disputes, or platform failures.

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Wyoming, without regard to conflict-of-law principles.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in the State of Wyoming, and the parties consent to personal jurisdiction therein.
